Charter Reservation Terms

Coast Guard Regulations
All chartered yachts are clean, well maintained, and fully insured for charter as required by the County of Orange. Vessels meet or exceed safety requirements by the United States Coast Guard (USCG) with on board equipment that includes Type 1 Personal Flotation Devices (life jackets) for every passenger, an approved sound producing device (bell, horn, whistle), fire extinguishers, visual distress signals (flares), a VHF radio, and an approved Ring Buoy. Yachts that carry more than six passengers and weigh over one hundred gross tons maintain a current USCG Certificate of Inspection. Uninspected Passenger Vessels (boats that carry up to six passengers) meet equipment, operation, and pollution prevention regulations established by the United States Coast Guard. Vessel Operators (Captains) possess a valid USCG license and both Captains and Deckhands are participants in a Coast Guard approved program of random screening for illegal drugs as required by 46 CFR Part 16. No yacht is allowed to exceed it’s Coast Guard defined maximum passenger capacity.

RESERVATIONs:
At this time Dana Island Yachts accepts bookings only via telephone or in-person. Your credit card will be charged at the time of booking to confirm your reservation. If you wish to pay with cash on the day of the charter, you must notify us when making the reservation. Payments via cash still require Dana Island Yachts to collect a credit card number, however, the card will not be charged unless you fail to arrive for your scheduled trip. We accept personal checks that are received no less than 10 business days in advance of your charter date.

Cancellations And Modifications:
The charter, considered fully confirmed when payment has been made, is non-cancelable, non-refundable, and nontransferable. Charter date, time, itinerary, or boarding location may only be changed upon approval from Dana Island Yachts and is subject to availability of vessel(s) and crew(s). You are responsible for additional fees, if applicable, that may be incurred from requested revisions. Charter begins at the time designated when you made the reservation, not at the time passengers arrive. In the event of a delayed arrival you may extend the length of the charter pending availability of yacht and crew for an additional fee. Should you choose, for any reason, not to arrive for your yacht charter on the scheduled date be advised that your credit card will not be refunded and you may not re-book your reservation without additional cost. Please allow plenty of driving time.

Inclement Weather:
Passenger safety and comfort is our first priority. Cancellations due to inclement weather/ocean is fully at the discretion of the Dana Island Yachts. If we must cancel the charter because of unfavorable or unsafe weather conditions you will be given the options of rescheduling to an alternate date of your choice or a full refund. Inclement weather is defined as rain (lengthy periods of heavy showers over a wide region of southern Orange County), strong sustained winds (over 20 knots), limited visibility due to dense fog, turbulent wave conditions, or any other situation that Dana Island Yachts considers a safety risk and/or could reduce passenger comfort.

Yacht Failure:
If a chartered yacht becomes unavailable due to mechanical failure, withdraws from charter service, or is sold by owner, Dana Island Yachts will substitute a comparable vessel of equal or greater passenger capacity. If the substituted yacht is unacceptable you may upgrade to an alternate yacht (additional fees may apply). Should no comparable or upgradeable vessel be available you have the right to reschedule (if applicable) or cancel the charter and have all payments refunded. Dana Island Yachts is not responsible for extraordinary events occuring beyond our control that may affect vessel chartered.

What To Bring:
Passengers should dress comfortably, casually, bring a warm jacket, and wear soft-soled shoes. Appropriate clothing should include layers of warmth since conditions could change during the charter. A camera, hat, and sunscreen are also recommended items. Most vessels have CD players available for use and some are capable of playing music from your iPod™.
For your safety and the well being of the yachts no hard-soled shoes, boots or high-heels are allowed. The Captain may have a passenger remove his or her shoes if proper foot attire is not worn.

Children:
Children 11 years old or younger may be required to wear a Coast Guard approved Type I PFD (lifejacket) provided by Dana Island Yachts. Please remember that your Captain and Crew are not child care providers. It is the responsibility of the child’s parent or legal guardian to provide supervision throughout the charter. You are welcome to bring aboard entertainment items, such as video games, for the kids to enjoy.

Food And Beverage:
Available food and beverage services will vary depending upon the yacht chartered and cruise itinerary. Choices may include having the event catered or bringing your own food and/or beverages aboard (called self-catering). Please note that you will be held liable for any damage to the vessel as a result of self-catering. Some yachts also have beverage services available for purchase. During the reservation process the charter coordinator will inform you of the catering options.
If allowed to provide your own beverages, please be advised that red wine is not permitted. White wine or champagne is allowed but must be consumed in shatter-proof cups.

Prohibited Items:
Dana Island Yachts has a strict Zero Tolerance Policy: no illegal substances are allowed. Any passenger found to be in possession of illegal substances will be immediately returned to the dock removed from the boat.
